These Terms of Service (“Terms”) govern your access to and use of trackmymarkers.com and the services provided by TrackMyMarkers (collectively, the “Service”). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

By registering an account, uploading data, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of the Service

TrackMyMarkers is a health-information platform that allows users to upload laboratory reports, extract and verify biomarker results, track markers longitudinally over time, compare results from different dates, generate educational summaries using AI, and create exportable reports for personal use and for sharing with healthcare professionals. The Service is provided for educational and organizational purposes only.

3. User Responsibilities

You agree to:

• Provide accurate and truthful information when creating your account.
• Upload only your own laboratory reports, or reports for which you have explicit authorization to manage (such as family members under your care).
• Verify extracted results against original laboratory reports before relying on them.
• Maintain the confidentiality of your account credentials.
• Use the Service in compliance with all applicable laws and regulations.
• Accept responsibility for all activity that occurs under your account.

5. Intellectual Property

The Service, including its design, software, biomarker library content, branding, and features, is owned by TrackMyMarkers and is protected by intellectual property laws. You retain full ownership of all laboratory reports, biomarker data, notes, and other content you upload to the Service (“User Content”).

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

6. Prohibited Uses

You agree not to:

• Use the Service to store or manage data for anyone without their authorization.
• Attempt to access another user’s data, account, or files.
• Upload content that is illegal, fraudulent, or infringes on the rights of others.
• Use the Service in any manner that could damage, disable, or impair the platform.
• Attempt to reverse-engineer, decompile, or extract source code or proprietary algorithms.
• Use AI outputs from the Service as a substitute for professional medical advice or to make clinical decisions.
• Resell, sublicense, or commercially exploit the Service without authorization.

7. Account Security

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. If you suspect unauthorized access, you must notify us immediately at support@trackmymarkers.com. We may suspend or terminate accounts that we believe have been compromised or used in violation of these Terms.

TrackMyMarkers offers both free and paid subscription plans. All prices are listed in USD. Paid plans are billed on a recurring basis (monthly or annually, depending on your selection) through our payment processor. By subscribing to a paid plan, you authorize us to charge the applicable fees to your payment method until you cancel.

• Subscription fees are billed in advance and are non-refundable, except as required by law.
• Annual plans are billed as a single upfront payment at a discounted rate compared to monthly billing.
• We may change pricing for new subscriptions or renewals with reasonable advance notice.
• Taxes, where applicable, are added to subscription fees at checkout or on your invoice.

9. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you will retain access to paid features until that date. Upon cancellation, your data remains accessible and you may continue using the Free plan or export your data. We do not issue prorated refunds for partial billing periods.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, store, and protect your data. You retain ownership of your User Content and may export or delete it at any time. By uploading content to the Service, you grant us the limited license necessary to process, display, and generate summaries from your data solely to provide the Service to you.

To the fullest extent permitted by law, TrackMyMarkers and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. This includes, without limitation:

• Any medical decisions made based on information displayed or generated by the Service.
• Inaccuracies in AI-extracted data, which you are responsible for verifying.
• Loss of data resulting from service interruptions, network issues, or account closure without prior data export.
• Damages resulting from unauthorized access to your account due to compromised credentials.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that extracted results will be accurate.

12. Indemnification

You agree to indemnify and hold harmless TrackMyMarkers, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, your infringement of third-party rights, or any medical decisions made based on information obtained through the Service.

13. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. For material changes, we will provide notice through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you may cancel your subscription and stop using the Service.

These Terms shall be governed by and construed in accordance with the laws of the State ofNC, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Raleigh County, NC, and you consent to the exclusive jurisdiction of such courts.
